           EXCEED $920,000
           Recommendation of City Manager:  Accept the bid dated July 21,
           2004, submitted by Dalaj International Corp. in response to the
           Specifications for Covering the East Side Storm Drain, from Belvidere
           Street to Mountain Street; reject all other bids received; and authorize
           the City Manager to enter into a contract not to exceed $920,000, which
           includes a base bid of $835,592.50 and $84,407.50 for any additional
           work the City may order pursuant to the Project Specifications.

      (2) AMENDMENT TO THE MASTER STREET TREE PLAN
           Recommendation of City Manager: Approve the following change to
           the Master Street Tree Plan to allow for the planting of a Cedrus
           deodara, Deodar Cedar in one location just east of the Prospect Street
           Bridge shown on the map attached to the agenda report.
           Recommendation of Urban Forestry Advisory Committee: The
           Urban Forestry Advisory Committee recommended approval of the staff
           recommendation at its regular meeting of February 18, 2004.
           Recommendation of Design Commission: The Design Commission
           recommended approval of the staff recommendation at its regular
           meeting on June 14, 2004.

      (3) APPROVAL OF THE MEMORANDUM OF UNDERSTANDING
           BETWEEN THE CITY OF PASADENA AND THE INTERNATIONAL
           BROTHERHOOD OF ELECTRICAL WORKERS (IBEW) FOR THE
           TERM JULY 1, 2003 THROUGH JUNE 30, 2006.
           Recommendation of City Manager: Approve a successor
           Memorandum of Understanding between the City of Pasadena and the
           International Brotherhood of Electrical Workers (IBEW) for the period
           July 1, 2003 through June 30, 2006, and authorize a journal voucher
           appropriating the necessary funds from the unappropriated fund balance
           and the Personnel Reserves to cover these increased costs.

6. APPEAL HEARING - 8:00 P.M.   
  A.  CONTINUED HEARING:  APPEAL OF A DECISION OF THE HISTORIC
       PRESERVATION COMMISSION TO DENY A CERTIFICATE OF
       APPROPRIATENESS FOR NEW CONSTRUCTION OF A FENCE AT 1029
       NORTH MARENGO AVENUE IN THE GARFIELD HEIGHTS LANDMARK
       DISTRICT
       Recommendation of City Manager:
       (1) Acknowledge that the application for a Certificate of Appropriateness for
        a new front yard fence in a landmark district is categorically exempt from
       environmental review pursuant to the guidelines of the California
       Environmental Quality Act (Section 15308: Class 8, Actions by Regulatory
       Agencies for Protection of the Environment).
       (2) Find that the design of the proposed fence - if modified - complies with
       the Secretary of the Interior's Standards, the Design Guidelines for  Historic
       Districts and the Garfield Heights Conservation Plan; and
       (3) Approve the application for a Certificate of Appropriateness with the
       following conditions:
           (a) The second pier on the south side of the front yard shall be
       removed (to create more transparency), and the spacing of the piers on the
       south side of the front yard shall be consistent with the spacing along the
       front of the lot. [source: maintain a "transparent character, allowing views into
       the yard and providing interest to pedestrians" Design Guidelines for Historic
       Districts, p. 80]
           (b) The applicant shall continue to work with the staff on an
       appropriate design for the tubular-steel pickets, and final details of the pickets
       (finish, dimensions, welded joints, spacing) shall be submitted to the staff for
       final review and approval.
           (c) The applicant is encouraged to soften the visual impact of the
       fence by planting shrubs or other suitable plant material along the base of the
       fence in the front yard.
       Recommendation of Historic Preservation Commission:  On June 7,
       2004, at a public hearing, the Historic Preservation Commission considered
       the application for a Certificate of Appropriateness for new construction of the
       front yard fence. The Commission denied the application based on a finding
       that the design of the fence was inconsistent with the adopted guidelines for
       front yard fences in landmark districts.  Members of the Commission
       encouraged the applicants to work with the staff on a redesign of the fence
       and to submit a new application.

           Recommendation of City Manager: It is recommended that the City
           Council direct the City Attorney to prepare an ordinance to amend the
           Pasadena Municipal Code Section 9.36.110 (Construction Projects) to:
           (1) Reduce hours for construction or repair work on buildings,
           structures or projects within a residential district or within a radius of 500
           feet from a residential district from:
               (a) From 7:00 a.m. to 9:00 p.m. to 7:00 a.m. to 7:00 p.m. Monday
                    thru Friday;
               (b) From 7:00 a.m. to 9:00 p.m. on Saturdays to 8:00 a.m. to
                    5:00 p.m. on Saturdays;
               (c) Construction is prohibited on Sundays and this will remain
                    unchanged; and
               (d) Add a provision to prohibit construction on holidays.
           (2) Delete the requirement of unanimous consent of the households
           adjacent to the construction site and retain the 65% consent of
           households within 500 feet.
